Waiver of Liability and Assumption of Risk

You are about to embark on an amazing adventure, as you trek to the top of the highest mountain in Africa.  However, there are many risks associated with high altitude mountain climbing:

  1. Your Kilimanjaro trek will take you into remote areas. Medical services or facilities may not be readily available or accessible during all or part of the trip. Should medical attention be required while on the mountain and you need to descend, you will be escorted or evacuated down to the nearest campsite or hut, and if necessary to the park gate. You will be responsible for paying for accommodations if you are escorted off the mountain. Should parents or guardians be trekking with a minor, and either the parent / guardian or minor needs to descend, you are required to descend together. No doctors or other health care providers accompany the group and travelers agree to assume all risks associated with illness, death, injury or altitude sickness as well as the lack of appropriate and timely medical attention. Traveler hereby gives Samba Treks permission to arrange emergency medical treatment for traveler if necessary; traveler agrees to hold Samba Treks and harmless for the provision or non-provision of such services. Bottled oxygen is available on each climb for emergency medical use only. Traveler must inform guide/s of any condition that should arise, even fatigue.

  2. The route you will ascend on this trek is not technical (requiring special mountaineering equipment) but this route is strenuous for most people due to the high altitude (19,340 feet at the summit (5,896 M)). This route has some steep sections and rock scrambling. This route is appropriate for those with hiking experience, but not for those with an extreme fear of heights. Trekking is much more strenuous in higher altitudes, and thus presents additional physical risks and challenges. It is important that you minimize these risks and the discomforts of high altitude trekking. Samba Treks encourages you to be in excellent physical condition prior to beginning this trek, and you must consult a physician prior to trekking with us and prior to beginning a Kilimanjaro training plan. You are responsible for ensuring that you are in sufficient good health to undertake the trip and that you stay healthy while on the trip.

  3. If you have any medical conditions that may be aggravated by contraindications with any medications you may be taking while you are on the mountain, please contact your doctor and notify your guides prior to your trek. Additionally, you must notify Samba Treks prior to booking your climb if you have any health conditions which may prevent you from climbing at high altitude safely. No doctors or other health care providers accompany the group and travelers agree to assume all risks associated with illness, death, injury or altitude sickness as well as the lack of appropriate and timely medical attention.

  4. When you arrive in Tanzania, you should be as healthy as possible. No one with a sore throat, cold, or with breathing problems should go above 10,000 feet. The purchase of travel cancellation insurance is strongly suggested. All travelers should be aware of what food, water and hygienic precautions can be taken to minimize the chance of gastrointestinal problems. Those travelers that need to purify or treat their own drinking water may bring iodine tablets or a water filter.

  5. Samba Treks provides training guidelines on our website, but these are based upon personal experience, recommendations by past trekkers, and mountaineering guidelines from various climbing organizations. It is important to note that people have successfully reached the summit of Kilimanjaro with little previous hiking experience, while some extremely fit individuals have succumbed to the effects of altitude and been unable to achieve their goal.


By submitting my final payment to Samba Treks, I agree that I am of lawful age and legally competent to understand the information contained in this liability release.  I understand the terms herein are contractual and not a mere recital, and that I have agreed this Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree that if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be severed from this Agreement. The remainder of this Agreement will then be construed as though the unenforceable provision had never been contained herein.

I understand and agree that I am not only giving up my right to sue the Released Parties but also any rights my heirs, assigns, or beneficiaries may have to sue the Released Parties resulting from my death. I further represent I have the authority to do so and that my heirs, assigns, or beneficiaries will be estopped from claiming otherwise because of my representations to the Released Parties.
